Individual programmes of instruction

These General Terms of Contract are an integral part of the contracts of instruction concluded by customers with academia Group Switzerland AG (referred to as “academia” below), Grendelstrasse 5, 6004 Luzern, Switzerland.

Wherever only a masculine formulation is used in these Terms of Contract, the relevant passages naturally refer to members of both gender categories.

Two or more customers are liable for the obligations assumed through this contract of instruction jointly and severally. This joint and several liability shall persist even in case of modification of civil status at a later stage.

Performance by academia

academia is committed to conduct the agreed programme of instruction. Instruction is given by appropriately qualified persons and on the basis of modern methods and didactic principles. Conclusion of a contract of instruction does not represent a guarantee for reaching the desired educational target.

Payment of tuition fee

Fees due for teaching may either be paid in the form of a single payment or in instalments as agreed. The single payment or instalments must be paid at the time specified in the contract of instruction and the quotation. The programme of instruction will not be started if the tuition fee or the first agreed instalment has not been paid.

Non-commencement or discontinuation of the agreed instruction

If a customer does not start with the lessons at all, academia can request compensation amounting to 15% of the total sum due for the agreed instruction. If, after commencement of lessons, an instalment is not paid within the agreed payment period, academia reserves the right to discontinue the programme of instruction until payment. If payment is not received after a reminder and an extension of the deadline by 10 days, academia can withdraw from the contract. In case of withdrawal from the contract, academia is entitled to the fee for the instruction provided, as well as to a compensation and cancellation charge amounting to 25% of the residual value of the agreed programme of instruction (i.e. equivalent to the value of the instruction not yet provided). The same shall apply if the customer discontinues or terminates the commenced instruction early.

Absences

Missed lessons do not release from the obligation to pay and a refund cannot be claimed. Lessons cancelled in time can be made up for as agreed. A cancellation is considered to be in time, if it is made no later than by 16:00 on the day before (by 17:00 on Friday for Monday lessons). The programme of instruction can be suspended and resumed at a later point in time, if the student is ill for a longer period of time or in case of accident or other critical events. Automatic extension of the contract to the end of the agreed programme of instruction shall occur if it is not terminated.

Public holidays and vacations

Vacations and public holidays are generally based on the regulations regarding vacations and public holidays applicable for the Canton in which teaching is provided.

Examination fees and teaching material

Examination fees and teaching material are not included in the school fees and are invoiced separately.

Organisation

academia learning is responsible for provision of staff as well as design of lessons. The school is entitled to replace a teacher during the term of the contract. It cannot be requested that teaching be given by a specific teacher. The school has the right to appoint a substitute in the event of absence of a teacher due to illness, accident, military issues etc.

Liability

As far as legally permissible, academia assumes no liability for the student – particularly with regard to accidents, losses, personal injury, material and pecuniary damage of any kind.

Place of jurisdiction is Basel.

Rates, price list

Rates for the new school year are published by academia every year before 31 March and customers are provided with a price list. If the customer does not terminate the contract of instruction with a regular notice period of at least 3 months before the end of the school year (31 July), the new rates are considered to be accepted and become an integral part of the contract.

Payment of tuition fee

Fees due for teaching may either be paid in the form of a single payment or in instalments as agreed. The due date of payment of the fee is specified in the contract of instruction or in the current price list.

Non-commencement of lessons and consequences of late payment

If a student does not start with the lessons, academia can request a compensation and cancellation charge amounting to the school fees due for three months plus 15% of the annual school fees. If, after commencement of the lessons, one or several instalments are not paid within the agreed payment period, academia reserves the right to exclude the student from the programme of instruction until settlement of all outstanding payments. Course fees shall also be owed for the time of exclusion. If payment is not received after a reminder and an extension of the deadline by 10 days, academia can withdraw from the contract. In case of withdrawal from the contract, academia is entitled to the fee for the instruction provided as well as to a compensation and cancellation charge amounting to the school fees due for three months plus 15% of the residual value of the remaining annual school fees (i.e. equivalent to the value of the instruction not yet provided). academia is entitled to charge a fee of CHF 40,00 each for a second or third reminder and a fee of CHF 100,00 for enforced collection.

Duration of contract and ordinary termination

Unless terminated by registered mail by one party with a notice period of at least three months before the end of the school year (31 July), the contract of instruction is extended by a further school year. In all cases, the contract of instruction will end with completion of the last year of school for which academia provides teaching.

Early termination during a school year by the customer

The contract of instruction can be terminated as of the end of a month by the customer by registered mail, subject to observation of the three-month notice period. In such a case, academia is entitled to the fee for the instruction provided and the school fees until the end of the notice period, as well as to a compensation and cancellation charge amounting to 15% of the remaining annual school fees (i.e. equivalent to the value of the instruction no longer provided until the end of the running school year/31 July). The school fees during the notice period as well as the compensation charge must also be paid if the student is withdrawn from the school before the end of the contract.

Extraordinary termination of contract by academia

academia can terminate the contract of instruction with immediate effect and without observation of the notice period if,

  • the student has grossly violated the school regulations or committed a serious disciplinary offence,
  • the student has been absent from lessons repeatedly despite written warning,
  • other important reasons make continuation of the contract of instruction unacceptable for academia.

In case of extraordinary termination of the contract, academia is entitled to the fee for the instruction provided as well as to a compensation and cancellation charge amounting to the school fees due for three months plus 15% of the residual value of the remaining annual school fees (i.e. equivalent to the value of the instruction not yet provided).

Absences

Additional services

Teaching materials are included in the school fees. Excursions, trips and school camps are not included in the school fees.

It cannot be requested that teaching be given by a specific teacher. The school appoints a substitute in the event of absence of a teacher due to illness, accident, military issues etc.

Liability
